YOU HEREBY GRANT AGENCY AUTHORITY TO ANY PARTY WHO CLICKS ON THE “I AGREE” BUTTON OR OTHERWISE INDICATES ACCEPTANCE TO THESE TERMS AND CONDITIONS ON YOUR BEHALF. ARBITRATION NOTICE: UNLESS YOU TIMELY OPT-OUT OF ARBITRATION IN ACCORDANCE WITH THESE TERMS AND CONDITIONS, YOU AGREE THAT DISPUTES BETWEEN YOU AND US OR YOU AND THE MEDICAL GROUPS OR PROVIDERS ARISING OUT OF OR RELATED TO THESE TERMS AND CONDITIONS OR THE SERVICE WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION AND YOU WAIVE YOUR RIGHTS TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION, AS FURTHER SET FORTH BELOW. WE EXPLAIN SOME EXCEPTIONS AND HOW YOU CAN OPT OUT OF ARBITRATION BELOW. IF YOU HAVE A MEDICAL EMERGENCY, SEEK IN-PERSON EMERGENCY CARE IMMEDIATELY OR DIAL 911. THE SERVICE IS NOT APPROPRIATE FOR ALL MEDICAL CONDITIONS OR CONCERNS. THIS AGREEMENT IS SUBJECT TO CHANGE AS PROVIDED HEREIN.
Healthon Inc. and/or its subsidiaries (collectively, “Healthon,” “we,” or “us”) owns and operates the websites located at www.healthon.com and may have previously, now, or in the future own and/or operate a “Healthon” mobile application (collectively, the “Platform”). Your access and use of the Platform, any part thereof, or anything associated therewith, including its content (“Content”), any products or services provided through the Platform or otherwise by Healthon, and any affiliated website, software or application owned or operated by Healthon (collectively, including the Platform and the Content, the “Service”) are governed by these Terms and Conditions (“Terms and Conditions” or “Agreement”). Please read this Agreement carefully because it sets forth the important terms you will need to know about the Service. In this Agreement, the terms “you” and “yours” refer to the person using the Service, or in the case of a use of the Service by or on behalf of a minor, “you” and “yours” refer to and include (i) the parent or legal guardian who provides consent to the use of the Service by such minor or uses the Service on behalf of the minor; and (ii) the minor for whom consent is being provided or on whose behalf the Service is being utilized. Please see the “Limited Use and Availability” Section of this Agreement for more information regarding use of the Service by minors and applicable limitations on such use. Notwithstanding the foregoing, the Service is not intended for individuals under the age of thirteen (13) and individuals under the age of thirteen (13) are prohibited from using all or any part of the Service or entering into this Agreement, even if a parent or legal guardian would be willing to provide consent to use of the Service or this Agreement. Please contact us at care@healthon.com if you are a parent or legal guardian of an individual under the age of eighteen (18) who you believe has used the Service without your consent.
As of March 19, 2025, Healthon operates in full compliance with all FDA regulations regarding the prescribing, dispensing, and distribution of GLP-1 receptor agonists, including but not limited to semaglutide and tirzepatide. The FDA has formally declared that the shortages of these medications have been resolved. As a result, compounded versions of these medications may only be prescribed and dispensed in cases where a valid medical necessity is documented by a licensed healthcare provider, as per FDA regulations and guidance. As part of your treatment plan, you may be prescribed a compounded medication containing either semaglutide (the active ingredient in Wegovy® or Ozempic®) or tirzepatide (the active ingredient in Zepbound® or Mounjaro®). These medications are compounded by a licensed pharmacy in accordance with your provider’s clinical judgment and your specific medical needs. Compounded medications are not approved by the U.S. Food and Drug Administration (FDA) and may differ from FDA-approved products in formulation, strength, purity, stability, or method of delivery. Your provider has determined that a compounded version is appropriate to support individualized dosing, flexible titration, or other medical needs not addressed by available commercial options. By signing this agreement, you consent to receive compounded treatment and acknowledge the potential risks and regulatory considerations associated with its use.
1. No Insurance Accepted & Financial Responsibility
Healthon does not accept commercial health insurance plans and is not enrolled with federal or state healthcare programs (e.g., Medicare and Medicaid). By using Healthon’s services, you acknowledge that you are obtaining products and services on a cash-pay basis and are solely responsible for all associated costs.
No Claims to Insurance: Healthon, its providers, and partner pharmacies will not submit claims for reimbursement to any federal or state healthcare programs.
Patient Agreement: If you are a beneficiary of a federal or state healthcare program, you agree not to seek reimbursement for any services received from Healthon.
2. Pharmacy Services & Prescription Fulfillment
If a prescription is issued through Healthon’s platform, the patient may choose a Healthon-affiliated pharmacy or an external pharmacy of their choice for fulfillment.
By using Healthon’s pharmacy services, the patient consents to the electronic transmission of health information and prescription details to their chosen pharmacy.
No Guarantee of Medication Availability: Healthon does not manufacture medications and cannot guarantee ongoing availability of any medication due to regulatory or supply chain issues.
3. Account Creation & Security
To access Healthon services, patients must create an account with accurate and complete information.
Confidentiality Obligation: Patients are responsible for securing their login credentials and must immediately notify Healthon of any unauthorized access.
Healthon reserves the right to terminate accounts that violate its policies.
4. Privacy & Data Usage
Healthon complies with HIPAA and other applicable privacy laws. Please refer to the Privacy Policy for details on how Healthon collects, stores, and uses patient data.
5. Ownership & Intellectual Property Rights
All content on Healthon’s platform (text, software, graphics, etc.) is owned exclusively by Healthon and cannot be copied, modified, or redistributed without written permission.
6. Legal Protections & Patient Acknowledgment of Regulatory Risks
By using Healthon’s services, you acknowledge and agree that:
Regulatory Changes May Impact Availability: If FDA regulations change, certain medications may become unavailable, and Healthon may be required to transition patients to alternative FDA-approved treatments.
No Liability for Supply Chain Issues: Healthon is not responsible for medication shortages, pharmacy delays, or regulatory actions affecting its partner pharmacies.
Compounded Medications & Medical Necessity: Patients who receive compounded medications acknowledge that these are not FDA-approved and may only be prescribed when a valid medical necessity is documented by a licensed healthcare provider.
7. Subscription Plans & Refund Policy
Healthon offers prepaid 3-, 6-, and 12-month subscription plans, where patients can pay monthly but receive their medications in advance for continued treatment.
Prorated Refund Terms: If Healthon is unable to fulfill refills due to regulatory restrictions, supply shortages, or unforeseen circumstances, a prorated refund will be issued based on the number of unused months remaining in the subscription at the time of cancellation. The refund will be calculated based on the unshipped portion of the listed monthly price of the prepaid plan, with deductions only for the monthly cost of any treatments already provided.
No Refunds for Shipped Medications: Any medication that has already been dispensed, shipped, or received by the patient is non-refundable.
Alternative Treatment Options: If a prescribed medication becomes unavailable, Healthon may offer an alternative treatment. Patients have the option to accept or decline the alternative and request a refund for the unused portion of their subscription.
8. Limitation of Liability & Indemnification
No Guarantees on Treatment Outcomes: Healthon does not guarantee the efficacy, safety, or long-term availability of any prescribed medication.
Patient Assumption of Risk: Patients assume full responsibility for their use of compounded medications and any potential risks associated with non-FDA-approved treatments.
Indemnification Clause: Patients agree to indemnify Healthon against any legal claims, liabilities, damages, or regulatory penalties arising from regulatory actions, supply chain disruptions, or patient non-compliance with treatment.
9. Dispute Resolution & Arbitration Agreement
Any disputes must be resolved through binding arbitration instead of court litigation.
No Class Action Lawsuits: Patients waive their right to participate in any class-action lawsuit against Healthon.
The arbitration process will be conducted under American Arbitration Association (AAA) rules, and any award decision is final.
10. Agreement to Changes in Terms & Services
Healthon reserves the right to update its Terms of Service based on regulatory changes, operational adjustments, or market conditions.
Continued use of Healthon’s services after any updates means acceptance of the new terms.
Legal Acknowledgment & Patient Consent
By signing this agreement, you acknowledge and agree that:

Regulatory Compliance: Your prescription and treatment plan are subject to FDA laws, state regulations, and Healthon’s third-party pharmacy policies.

Potential Changes in Treatment: Due to ongoing regulatory developments, Healthon and its partner pharmacies may be required to discontinue compounded medications and transition patients to FDA-approved alternatives.

No Guarantee of Medication Availability: Healthon does not warrant the uninterrupted availability of any medication and will not be held liable for delays, discontinuations, or changes in pharmacy regulations.

Refund Limitations: Any refunds provided under this agreement will be prorated based solely on unfulfilled prescription months and do not include any reimbursement for already dispensed medications.

Legal Compliance: Healthon operates in strict adherence to federal and state regulations. Any attempt to seek compounded medications outside of medical necessity guidelines is not permitted under this agreement.
By signing below, you confirm that you have read, understood, and agreed to the above terms.
Exclusions from the Weight Loss Guarantee Program
You are not eligible for the Healthon Weight Loss Guarantee Program if:
You have certain pre-existing medical conditions, including but not limited to thyroid cancer, severe eating disorders, or other health conditions that may interfere with weight loss treatment.
You are pregnant, actively trying to conceive, or breastfeeding at any point during the program.
You have experienced significant hormonal changes that could impact weight loss results.
You are using other weight loss treatments, medications, or supplements outside of those prescribed by Healthon-affiliated healthcare providers during the 6-month program period.
You fail to meet any other eligibility criteria as outlined in Healthon’s Weight Loss Guarantee Program terms.
Verification Process for Weight Loss Guarantee Refunds
To request a refund, you must email care@healthon.com and select one of the following verification methods:
You must be a patient of ours for at least 6 months.
Self-Attestation:
You must record a video verification of yourself weighing in on a scale, ensuring the following conditions are met:

The scale reading must be clearly visible in the video.

The video must be time-stamped and recorded in a well-lit environment.

You must also complete the attestation requirement on our designated platform (Healthie) with continuous data synchronization for monitoring. Submit both the recorded video and the completed attestation to care@healthon.com.
How the Verification Process Works
Healthon’s team will review all submitted materials to confirm compliance with program requirements.
Refund eligibility will be determined based on the accuracy, authenticity, and completeness of your submission.
Only submissions using Healthon’s approved platform will be reviewed. No other forms will be accepted.
The final eligibility decision rests solely with Healthon and is non-negotiable.
Refund Processing & Limitations
If approved, refunds will be processed within 30 days of verification completion.
Refunds apply only to membership fees paid for the eligible service during the first six months.
Non-refundable expenses include:

Any incidental costs related to the verification process (e.g., third-party provider consultation fees).

Additional program fees, products, or services purchased outside the scope of the Weight Loss Guarantee.

Refunds will be credited to the original payment method used for enrollment.

Refund eligibility is non-transferable and cannot be applied to future services.
Special Advertising Offers
From time to time, Healthon may offer promotional pricing on certain services.
All advertised offers are available for a limited time only and will automatically expire within 24 hours of removal from the website.
“Same price per dose” or similar promotional offers are subject to additional terms, including:

Healthon reserves the right to adjust pricing based on supply and market conditions.

“Same price per dose” offers expire within 24 hours of a price change.

Promotional offers such as "first month free" are separate from “same price per dose” and are subject to different terms.

Friend, Family and Referral Program
1) Introduction & Purpose
Healthon’s Refer a Friend Program (the “Program”) is designed to allow existing Healthon members (“Referrers”) to invite friends (“Friends”) to enroll in a Healthon service or subscription plan using a personalized referral link (the “Referral Link”).
Through this program, Friends receive a discount on their first eligible order, while Referrers earn rewards for each successful referral.
2) Definitions

Referrer: A current Healthon member who refers a Friend.

Friend: The individual receiving the referral invitation.

Program: The Healthon Refer a Friend initiative for new customer acquisitions.

Company: Healthon, the entity operating the Program

Friend’s Reward: A one-time amazon gift card depending on the current family promotion..

Referrer’s Reward: A one-time amazon gift card depending on the current family promotion..
3) Eligibility Criteria

The Program is open only to U.S. residents aged 18+ in eligible states.

Only natural persons using Healthon’s services for personal use are eligible.

Any attempt to circumvent eligibility rules (e.g., creating multiple accounts) will result in immediate disqualification and forfeiture of all rewards.
4) Referral Process
To be eligible, Referrers must be active Healthon members.
Friends must not have been a Healthon customer within the last 12 months.
Friends must provide referrer’s Healthon’s member information.
5) Restrictions & Compliance
Healthon reserves the right to revoke any reward if referral activity is determined to be fraudulent or in violation of these terms.
7) Program Modifications & Termination
Healthon reserves the right to modify or terminate the Refer a Friend Program at any time without notice.
If the Program is terminated, unused referral rewards will expire after 30 days.
Acceptance of Terms and Conditions
Your access to and use of the Service is subject to this Agreement, as well as all applicable laws and regulations. If you do not accept and agree to be bound by this Agreement in its entirety, you are strictly prohibited from visiting, accessing, registering with, and/or using the Service or any information or Content provided through the Service, except as necessary to review this Agreement. The Service is continually under development, and we reserve the right to revise or remove any part of this Agreement or the Service in our sole discretion at any time and without prior notice to you. Any changes to this Agreement are effective upon posting to the Platform. Unless otherwise indicated, any new Content added to the Service is also subject to this Agreement upon posting to the Platform. If you disagree with this Agreement or any terms or conditions herein, your sole remedy is to discontinue your use of the Service. Your continued use after a change to this Agreement has been posted constitutes your acceptance of this Agreement as modified by such changes.
Your Relationship with Us
We make available to individuals who register as users of the Service (“Users”) certain products and services sold or offered by Healthon or by third-party medical providers, pharmacies, or other vendors via our Service. Our Service provides access to prescription fulfillment services offered by certain partnered pharmacies (the “Pharmacies”) and, from time to time, may offer laboratory services from certain laboratories (the “Labs”). You agree and understand that your prescription(s) may be filled by and transferred between the Pharmacies, and agree that the Service may do so on your behalf. We may also provide you with access to one or more of the following medical groups who provide healthcare and/or mental health services through the Platform (the “Medical Groups”): Healthon Medical Group Inc. and one or more other professional medical groups that we may provide access to. These medical groups employ or contract with physicians, allied health professionals, and mental health professionals who offer certain healthcare and/or mental health services through the Platform (“Providers”). By accepting this Agreement, you acknowledge and agree that any services you receive from the Labs, Pharmacies, Medical Groups, or Providers through the Platform are also subject to this Agreement, and that the Labs, Pharmacies, Medical Groups, and Providers are third-party beneficiaries of this Agreement. We do not control or interfere with the practice of medicine or mental health care by the Medical Groups or any Providers, each of whom is solely responsible for directing the medical care, mental health care, and/or treatment they provide to you. By accepting this Agreement, you acknowledge and agree that Healthon is not a healthcare provider and that by using the Service, you are not entering into a doctor-patient or other health care provider-patient relationship with Healthon. By using the Service, you may, however, be entering into a doctor-patient or other health care provider-patient relationship with the Medical Group and/or one or more Providers. Further, we do not control or interfere with any professional service provided by the Labs and Pharmacies, each of which is solely responsible for their provision of professional services rendered via the Service. By accepting this Agreement, you acknowledge and agree that the Medical Group and/or Providers may send you messages, reports, and emails via the Service regarding your diagnosis and/or treatment. You understand and agree that Healthon is not responsible for the security or privacy of communications services you use to receive the aforementioned messages, reports, and emails sent via the Service. You further understand and agree that it is your sole responsibility to monitor and respond to these messages, reports, and emails and that neither Healthon nor the Medical Group nor any Provider will be responsible in any way and you will not hold Healthon, the Medical Group, or any Provider liable for any loss, injury, or claims of any kind resulting from your failure to read or respond to these messages or for your failure to comply with any treatment recommendations or instructions from the Medical Group or your Provider(s). While you are not establishing a doctor-patient or other health care provider-patient relationship with Healthon, by using the Service, you are establishing a direct customer relationship with Healthon to use the Service, including the purchase of any non-prescription products or non-medical services sold directly to you by Healthon via the Service. In connection with such a relationship, you may provide to us, or cause to be provided to us on your behalf, personal information, including health information, that is subject to use by us in accordance with our Privacy Policy (available at: https://healthon.com/privacy-policy/). Please refer to the “Privacy Policy” section and the “Protected Information” section below for additional information.
Notice Regarding Your Financial Responsibility for Services
Healthon and the Medical Groups are not enrolled with, and are not participating providers with, any federal or state healthcare programs (i.e., Medicare, Medicaid) for the provision of any health care or mental health services or supplies and, as such, neither you nor Healthon or the Medical Groups may receive payment from such programs for the services or products provided to you by Healthon or the Medical Groups. Further, to the extent that any of the Labs, Pharmacies, or Providers may be enrolled in federal or state healthcare programs, the means through which the services and products are provided or made accessible through the Service typically precludes such services and products from being covered benefits under these programs. By choosing to use the Service, you are specifically choosing to obtain products and services on a cash basis outside of any federal or state healthcare program. Thus, you are solely responsible for the costs of any service or product provided to you. By agreeing to use the Service, you acknowledge and agree that (1) you are explicitly choosing to obtain products and services on a cash basis outside of any federal or state healthcare program and you have sole financial responsibility for all services or products provided to you by or through the Service; and (2) neither you nor Healthon, the Labs, the Pharmacies, the Medical Groups, or the Providers will submit a claim for reimbursement to any federal or state healthcare program for the costs of the services and products provided to you through the Service.
Subscription Products and Services
Certain products and services available for purchase through the Service require that you purchase the product and/or service on an automatically renewing subscription basis. For subscription-based products and services, your payment device will be automatically charged at regular intervals as described for that product or service during the checkout process (including over a telephone conversation) until you cancel your subscription. Your first renewal may be charged early to prevent any discontinuity in treatment. Your subsequent shipments may be charged and shipped up to two (2) days early to accommodate holidays or for other operational reasons to support continuity of treatment. We and/or the Providers may, but are not required to, perform outreach to you from time to time via the Service to request updates to your information and to facilitate ongoing subscriptions. You may cancel a subscription at any time by emailing care@healthon.com and directly requesting a cancellation, or by calling 949 668 7000 to cancel. YOUR SUBSCRIPTION SHALL CONTINUE ON A MONTH-TO-MONTH BASIS UNTIL CANCELLED BY YOU OR HEALTHON. YOU SHALL NOT BE CHARGED AFTER A CANCELLATION BECOMES EFFECTIVE. YOU MUST GIVE 30 DAYS' NOTICE OF CANCELLATION TO HEALTHON IN WRITING BY EMAILING: care@healthon.com. THERE WILL BE NO REFUNDS OF ANY SUBSCRIPTION FEES PAID PRIOR TO THE CANCELLATION BECOMING EFFECTIVE. Cancellation will take effect at the end of such thirty-day notice period. Your subscription will automatically renew until the cancellation effective date. We do not offer refunds for partially used subscription periods, although we may provide refunds on a case-by-case basis in our sole and absolute discretion. We may change our subscription plans and prices from time to time; however, we will provide you advance notice of any price changes or changes to your subscription plans. Please carefully read the additional terms applicable to your particular subscription plan at the time of checkout. Unfortunately, we cannot cancel or refund medication shipments after they have been ordered by your provider. This is because the pharmacy has already begun the process of preparing your medication to be shipped to you. Healthon is not responsible for any orders after they have been shipped from the pharmacy. We cannot issue refunds for medications that have proof of delivery from the carrier. We can re-order your medication but there will be a new charge associated with this order. If you would like to file a lost or stolen package claim you can contact the delivery carrier directly to do so. Any other Services that are paid per Service (e.g., single visits with a Provider not part of a Subscription) may be rescheduled but are not cancellable after purchase. All medication orders are final once shipped by the Pharmacies and the order cannot be returned or refunded. This is to protect the integrity of the medication and the health of the patient, as well as to comply with applicable laws. However, if you think you have received the wrong medication, have received an order in error, or have any other questions, please contact us at care@healthon.com. In order to simplify the user experience through the Service, you will only see and be required to pay a single “total” subscription price. However, if a subscription product you purchase required a consultation with a Provider, includes a prescription product that you fill through one of the Pharmacies, includes a laboratory diagnostic service provided by one of the Labs and/or includes mental health services, then the total price you pay includes the amounts charged for use of the Service, as well as amounts charged by the Pharmacy for the prescription drug, the Lab for the diagnostic testing, and the amount charged by the Medical Group for the services of the Provider, as applicable, which amounts are collected on behalf of and paid to the Pharmacies and Medical Groups, respectively.
Prescription Products
Certain products available through the Platform require a valid prescription by a licensed healthcare provider. You will not be able to obtain a prescription product unless you have completed a consultation with one of the Providers, the Provider has determined the prescription product is appropriate for you, and the Provider has written a prescription. If a Provider determines a prescription product is appropriate for you and writes a prescription, you will receive information about your options for filling the prescription. Certain prescriptions can be filled through one of the Pharmacies by using the Platform or you may fill the prescription at any pharmacy of your choice as prompted during your use of the Service or by emailing your request to care@healthon.com. Prescriptions may also be transferred among the Pharmacies without notice. Not all prescriptions fulfilled by the Pharmacies use child-resistant packaging and your prescription product may not be dispensed in a child-resistant container. Some prescriptions are not available through the Pharmacies or must be filled by a local pharmacy of your choice as prompted during your use of the Service, including prescriptions used for many common primary care conditions. If you complete a consultation with a Provider and fill a prescription through one of the Pharmacies, the prescription product is shipped to you by the applicable Pharmacy and the costs associated with the prescription are included in the total charged to you by the Service as described in the “Subscription Products” section above. If you fill a prescription with a pharmacy other than the Pharmacies, the Service will send the prescription to your selected pharmacy, but you will be responsible for picking up or otherwise obtaining the prescription product and paying the pharmacy directly for the cost of the prescription product. Prescription products available through the Platform are “Third-Party Goods and Services” as described in the Third-Party Goods and Services section of this Agreement.
Laboratory Products and Services
Certain laboratory products and services available through the Platform, including at-home testing kits and services, require a valid prescription or order by a licensed healthcare provider. You will not be able to obtain such laboratory services unless you have completed a consultation with one of the Providers, the Provider has determined the laboratory product and/or service is appropriate for you, and the Provider has prescribed or ordered the laboratory product and/or service. Currently, laboratory products and services offered through the Platform can only be ordered and fulfilled through the Labs and are not available through local laboratories. If you receive laboratory products and/or services from a Lab through the Platform, the applicable testing materials are shipped to you by the applicable Lab, and the costs associated with the laboratory products and services are included in the total charged to you by the Service. Laboratory products and services available through the Platform are “Third-Party Goods and Services” as described in the Third-Party Goods and Services section of this Agreement.
Limited Use and Availability
Our Service is currently only available to individuals who are located in states in which we offer the Service, are at least eighteen (18) years of age or older, or at least the age of majority in their jurisdiction of residence, if higher than eighteen (18) (or based on the Provider’s discretion, thirteen (13), and who have accepted this Agreement. By visiting, accessing, registering with or using the Service, you are (a) representing and warranting to us that you are either (1) at least eighteen (18) years of age or older or at least the age of majority in your jurisdiction of residence, if higher than eighteen (18), or (2) at least thirteen (13) years of age, have obtained consent from your parent or legal guardian to use the Service; (b) if you are a parent or legal guardian providing consent for an individual minor who is under the age of eighteen (18) (or such higher age of majority under applicable state law), representing and warranting to us that you are the parent or legal guardian for such minor and have all legal power and authority to provide consent for the use of the Service by such minor; (c) representing and warranting to us that when you use the Service to consult with a Provider, you are located in the same state as the shipping address you provide in your account at the time that you conduct such consultation; (d) agreeing to comply with all applicable laws in visiting, accessing, registering with our using the service; and (e) agreeing that you will only use the Service for lawful purposes. Our Service is subject to state regulations and may change from time to time due to changes in applicable regulatory requirements. Certain products available through the Service are subject to additional age restrictions, and not all products or services are available to all ages. In some cases, the Service may not be the most appropriate way for you to provide information to, communicate with or seek medical and/or mental health care and treatment from a healthcare provider or mental health professional. For example, certain medical conditions may require an in-person procedure or a healthcare provider other than your Provider, or your Provider may determine that your diagnosis and/or treatment requires an in-person office visit or are otherwise not appropriately addressed through use of the Service. In such a case, you may receive notification that you will be unable to use the Service for the particular issue you submitted with additional information regarding next steps.
Consent to Use of Telehealth Services
Telehealth involves the delivery of health and mental health care services using electronic communications, information technology or other means between a healthcare provider or mental health professional and a patient who are not in the same physical location. While the provision of health and mental health care services using telehealth may offer certain potential benefits, there are also potential risks associated with the use of telehealth. The telehealth services are not a substitute for in-person care in all cases. In order to use the Service, you will be required to review and agree to an informed consent regarding the use of telehealth (the “Patient Consent”) that will be provided to you via the Service. You agree that Healthon is a third-party beneficiary of the Patient Consent and has the right to enforce it against you.
Duty to Provide Information, Access, and Connectivity
You are responsible for providing and maintaining, at your own risk, option and expense, appropriate software and hardware capabilities (consistent with any technical, quality or other requirements described in the Service) to enable use of the Service, including but not limited to, a computer or mobile device with a video camera and Internet access. You are solely responsible for any fees, including Internet connection or mobile fees, that you incur when accessing the Service. You also have a duty to provide truthful, accurate and complete information in any forms or other communications you submit to or through the Service. We reserve the right to change the access configuration, including any software, hardware, or other requirements of the Service at any time without prior notice.
